Onboarding Requirements for EOR Employees in Argentina & Their Purpose

1. Employee Identification & Personal Information

Required Documents:

  • National ID (DNI – Documento Nacional de Identidad) for Argentine nationals

  • Passport (for foreign employees)

  • CUIL (Código Único de Identificación Laboral)

Purpose:

  • The CUIL is the employee’s unique labor identification number issued by Administración Nacional de la Seguridad Social (ANSES).

  • It is required for:

    • Social security contributions

    • Pension registration

    • Health insurance contributions

    • Payroll reporting

Without a valid CUIL, an employee cannot be legally registered for employment.

2. Registration with Tax Authorities (AFIP)

Requirement:

Globalli must register employees with Administración Federal de Ingresos Públicos (AFIP) before or on the employee’s first working day.

Purpose:

  • Officially declares the employment relationship

  • Ensures proper income tax withholding

  • Enables employer and employee social security contributions

  • Prevents penalties for unregistered employment

Failure to register employees properly may result in significant fines and labor claims.


3. Employment Contract

Requirement:

While employment can legally be verbal, a written contract is strongly recommended and required in specific cases (e.g., fixed-term contracts).

Contract Must Include:

  • Job title and responsibilities

  • Salary and payment frequency

  • Working hours

  • Start date

  • Probation period (typically 3 months)

  • Collective Bargaining Agreement (if applicableO)

Purpose:

  • Establishes legal clarity between employer and employee

  • Ensures compliance with Argentina’s Labor Contract Law (Ley de Contrato de Trabajo)

  • Defines rights and obligations of both parties

4. Social Security & Pension Enrollment

Globalli must register employees for contributions covering:

  • Pension system

  • Family allowances

  • Occupational risk insurance

  • Health insurance (Obra Social)

Authorities Involved:

  • Administración Nacional de la Seguridad Social (ANSES)

  • Occupational Risk Insurance Provider (ART – Aseguradora de Riesgos del Trabajo)

Purpose:

  • Provides retirement benefits

  • Covers workplace accidents

  • Grants access to healthcare services

  • Ensures compliance with mandatory labor protections

5. Health Insurance (Obra Social)

Requirement:

Employees must be enrolled in an approved health insurance fund (“Obra Social”).

Purpose:

  • Grants access to public or union-based healthcare coverage

  • Funded through mandatory payroll contributions

  • Required by Argentine labor law

Employees may select their preferred Obra Social within the regulated system.

6. Occupational Risk Insurance (ART)

Requirement:

Globalli must contract an ART provider before employee start date.

Purpose:

  • Covers workplace injuries and occupational illnesses

  • Provides medical care and disability compensation

  • Protects employer from direct liability in workplace accidents

Failure to secure ART coverage can result in severe financial and legal consequences.

7. Payroll Setup Requirements

Information Needed:

  • Bank account details (CBU – Clave Bancaria Uniforme)

  • Tax category (income tax status)

  • Family dependents information (for tax and allowance purposes)

Purpose:

  • Ensures accurate payroll processing

  • Correct income tax withholding

  • Proper calculation of social security contributions
